Terms of Service & 10DLC Policy

1. Agreement to Terms

These Terms of Service & 10DLC Messaging Policy constitute a legally binding agreement between your organization and Grapphen LLC, a Wyoming limited liability company.

By activating SIP trunks, assigning softphone extensions, configuring Sofia Voice AI bots, or executing SMS outreach campaigns on Grapphen Vox (the "Platform"), you affirm your complete agreement with these provisions.

2. A2P 10DLC & Candidate SMS Compliance

All outbound SMS traffic originated across local 10-digit telephone numbers (10DLC) must be registered with The Campaign Registry (TCR) before broadcast.

• Verifiable Opt-In: You warrant that all recipient phone numbers were obtained through clear, affirmative written consent (such as career applications, candidate portal submissions, or direct recruitment outreach).
• Mandatory Keywords: All SMS campaigns automatically support standardized opt-out keywords (STOP, UNSUBSCRIBE, CANCEL, QUIT) and help keywords (HELP, INFO). Once a recipient transmits STOP, automated software locks that telephone number against subsequent transmissions.
• Sender Identification: The initial message in any outreach thread must clearly state your company or recruitment brand name.

3. Sofia Voice AI Agent Disclosure & FCC Rules

Grapphen Vox provides neural conversational voice agents (Sofia AI) engineered for candidate pre-screening and automated interview coordination.

• AI Identity Disclosure: In accordance with federal guidelines, Sofia Voice AI transparently announces its synthetic status at the start of autonomous calls (e.g., "Hello, this is Sofia, an automated AI recruiting specialist on behalf of [Company]").
• Human Escalation & Whisper: Calls support immediate transfer or whisper barge-in by human recruiter supervisors at any point during active sessions.
• No Deceptive Impersonation: Using voice synthesis to impersonate government agencies, banking entities, or specific private individuals without authorization is strictly prohibited.

4. Carrier Number Porting & Local Presence

Grapphen Vox facilitates complimentary Letter of Authorization (LOA) number porting from prior telecom carriers.

Local presence caller ID provisioning is subject to geographic permissioning and carrier attestation. You agree not to spoof caller IDs or display telephone numbers for which your organization does not hold legal right of use.

5. Call Recording, Transcription & Wiretap Laws

Dual-channel cloud call recording is an enterprise administrative feature. You are solely responsible for complying with state and federal two-party / all-party consent recording statutes (including California, Illinois, Florida, and Pennsylvania wiretapping provisions).

The Platform provides automated audio consent prompts ("This call may be monitored or recorded for quality assurance") which administrators may enable by default across all outbound and inbound queues.

6. Anti-Robocall & Acceptable Use Policy

Transmission of unsolicited telemarketing, high-frequency blast autodialing without valid opt-in, or violation of National Do Not Call (DNC) registry rules will result in immediate trunk termination and potential reporting to carrier upstream registries.

7. Telecom Billing, Carrier Pass-Through & USF

Standard recurring subscription tiers (Solo at $5.99/mo, Team at $9.99/user/mo, Pro at $19.99/user/mo) include designated softphone licenses and softphone terminal features. E911 regulatory surcharges, Federal Universal Service Fund (USF) fees, and TCR brand registration fees are calculated transparently and billed at direct carrier cost.

8. Governing Law & Jurisdiction

These Terms and any dispute relating to Grapphen Vox telephony services shall be governed exclusively by the laws of the State of Wyoming, USA, and resolved in state or federal courts situated in Wyoming.
